A 19-year-old motor boy identified as Chinanu Mbeayi, was on Monday arraigned before an Apapa Magistrates’ Court for allegedly causing the death of one Oluodun Ogundele in Apapa.
Mbeayi is facing a two-count charge bordering on manslaughter and driving without driver’s licence.
The prosecutor, Inspector Donjour Perezi, told the court that the defendant committed the offence on August 15, 2018 at about 7:30pm along Oshodi/Apapa Expressway by MTN Junction, Apapa.
“The defendant being the motor boy in charge of Mack Truck with registration number: LAGOS KJA 613 XC drove same on the public highway in a manner which was reckless and dangerous to public having regard to the circumstance of the case including the nature, condition and use of the Highway Code,” Perezi said.
The prosecutor added that the defendant caused the death of one Oluodun Ogundele (40) who is a resident of No. 9 Bridge Road, Otto, Lagos by hitting him to one Mack petrol tanker with registration number: LAGOS APP 44 XQ driven by one Oyerinde Afeez.
Perezi also said that the defendant drove the truck without driver’s license.
According to him, the offences are punishable under sections 20 and 7(1) of the Road Traffic Act, Law of Lagos State 2012.
The defendant pleaded not guilty to the charge against him.
Magistrate O.A Erinle granted the defendant bail in the sum of N800,000 with two responsible sureties who must be gainfully employed and one of them must be a house owner.
The sureties, according to the Magistrate, must furnish the court with proof of tax payment to the Lagos State Government and six months bank statement.
She adjourned the case till October 2, 2018 for mention.
In a similar development, a 40-year-old truck driver, Oyerinde Afeez was arraigned before an Apapa Magistrates’ Court for causing the death of one Olubode Ogundele.
Afeez is facing a one-count charge bordering on manslaughter.
The prosecutor, Inspector Donjour Perezi, told the court that the defendant committed the offence on August 15, 2018 at about 7:30pm along Oshodi/Apapa Expressway by MTN Junction, Apaja.
“The defendant being the driver of a Mack petrol tanker with registration number: LAGOS APP 44 XQ drove same on the public highway in a manner which was reckless and dangerous to public having regard to the circumstance of the case including the nature, condition and use of Highway Code,” Perezi said.
The prosecutor also said that the defendant caused the death of one Olubode Ogundele by permitting him to hang side of the vehicle.
According to him, the offence is punishable under section 19 (1) of Road Traffic Act, Law of Lagos State 2012.
The defendant pleaded not guilty to the charge against him.
