A Federal High Court sitting in Lagos has restrained Japaul Oil & Maritime Service Plc and two other defendants and their agents from transferring, or paying any money standing to the credit or which may incur to its benefit in the account possession of Total Upstream and Total Exploration & Production Nigeria Ltd through banks in respect of the Time Charter Agreement for the use and hire of the MDPL Randeep MI Limited. Justice Mohammed Idris’ order was sequel to the ex-parte motion filed by the plaintiffs, MDPL Randeep Mi Limited and MDPL Anjali MI Limited through their counsel, Chidi Ilogu SAN in the suit delineated FHC/ L/CS/1020/2015. The plaintiffs had asked the court to restrain the defendants from transferring money whether by themselves or agents to the credit or benefit defendants in respect of the time charter agreement for the use and hire of the plaintiff vessel. Defendants in the suit are Japaul Oil & Maritime Service Plc; Total Upstream Nigeria Limited and Total Exploration & Production Nigeria Ltd as first to third defendants respectively. Among other order granted by the court are interim order of Mareva injunction restraining 1st defendant by itself or agents from removing, repatriating and/or exporting out of Nigeria any of its direct or indirect assets including funds presently standing to its credit with 2nd and 3rd defendant and any person or parties sought to be restrained.
