A 54-year-old truck driver, Mudasiru Akangbe, was on Wednesday arraigned before an Apapa Magistrates’ Court for allegedly causing the death of one 37-year-old, Hassan whose surname is yet unknown in Lagos.
Akangbe is facing a three-count charge of manslaughter, traffic offence and causing accident.
The prosecutor, Inspector Gabriel Ekundayo, told the court that the defendant committed the offences on February 19, 2019 at about 9:30pm at First Gate Bus Stop along Badagry/Mile 2 Express, Lagos.
“The defendant being the driver in charge of one Mack Truck with registration number AKD 542 XX drove same on the public highway in a manner which was reckless and dangerous to the public, having no regard to all the circumstances,” Ekundayo said.
The prosecutor also said that the defendant drove the same vehicle in a reckless and dangerous manner, which caused the death of one Hassan.
Ekundayo added that the defendant drove the Mack Truck in a dangerous manner and caused serious damage to MAN Diesel Truck with registration number AGL 727 XV property of one Tejiri Ziregbe of Calleri Home Prince Samuel Adedoyin Street, Lekki, Lagos State.
According to him, the offences are punishable under sections 29, 20 and 20(1) of the Road Traffic Act, Law of Lagos State of Nigeria 2012.
The defendant pleaded not guilty to the charges against him.
In his ruling, Chief Magistrate Mukaila Fadeyi granted the defendant bail in the sum of N500,000 with two responsible sureties.
According to the Chief Magistrate, one of the sureties must have landed property in Lagos.
He ordered the case file to be transferred to the Directorate of Public Prosecution (DPP) for advice.
He adjourned the case till March 4, 2019 for mention.
