A 35-year-old truck driver, Ahamadu Lagbo, was on Monday arraigned before an Apapa Magistrates’ Court for allegedly colliding on a motorcycle rider who later died while receiving treatment.
Lagbo is facing a two-count charge bordering on manslaughter and driving without vehicle licence.
The prosecutor, Sergeant Iyabosa Onaiwu, told the court that defendant committed the offences on November 22, 2018 at about 9:30am along Ijora Seven-Up fly over bridge inward Apapa, Lagos.
“The defendant being the driver in charge of Mack truck with registration number APP 853 XH drove same truck in a manner which was dangerous to the public having regard to all the circumstances of the case including the nature, condition and use of the highway and to the amount of traffic which actually is at the time or which might reasonably be expected to be on the highway collided on motorcycle with registration number KTU 421 QL. Consequently the rider of the bike, one Mohammed Alhaji, died while receiving treatment,” Onaiwu said.
The prosecutor also said that the defendant drove same vehicle on the public highway without driving licence.
According to her, the offences are punishable under sections 18 and 1 of the Traffic Act, RTA, Law of Lagos State 2012.
The defendant pleaded not guilty to the charges against him.
Magistrate, O.S Abioye granted the defendant bail in the sum of N200,000 with two responsible sureties in like sum.
The sureties, according to the Magistrate must be gainfully employed and furnish the court with two years tax payment to the Lagos State Government.
The Magistrate ordered that the case be transferred to Directorate of Public Prosecution (DPP) for advice.
He adjourned the matter till December 20, 2018 for mention.
